2 09-08-2018 Heard the learned counsel for the petitioner and counsel appearing on behalf of the State.

The petitioners are in custody since 07.04.2018 in connection with Runnisaidpur P.S. Case No.170 of 2018, registered under Sections 20(B)(ii) and 29 of the N.D.P.S. Act.

The learned counsel for the petitioner submits that the alleged recovery were made from the house of the petitioner and not from the conscious possession of the petitioner and the quantities shows to have been recovered commercial quantity. It is further submitted that the seizure list did not disclose the signature of the petitioner and, therefore, it would be found to accept.

In view of the aforementioned facts and circumstances of the case and the period of custody, let both the petitioners, above named, are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge, N.D.P.S. Sitamarhi, in connection with Runnisaidpur P.S. Case No.170 of 2018.
