The petitioner seeks bail in Jhajha P.S. Case No. 01 of 2017 registered under Section 394 of the Indian Penal Code.

Three four unnamed accused persons are said to have committed robbery in the house of the informant and looted away cash and belongings of the inmates of the house.

It is submitted by learned counsel for the petitioner that the petitioner is neither named in the F.I.R. nor was apprehended on the spot. No incriminating article has been recovered from his conscious physical possession. He was not put on T.I.P. There is nothing in the record indicating the complicity

of the petitioner in the occurrence barring the confessional statement of co-accused Ajay Yadav who has been enlarged on bail by a co-ordinate bench of this court in Cr. Misc. No. 31330 of 2017 vide order dated 13.07.2017. The petitioner has been languishing in custody since 02.05.2017.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Jamui in connection with Jhajha P.S. Case No. 01 of 2017.
