The petitioner seeks bail in connection with Noorsarai P.S. Case no. 99 of 2017 registered under Sections 328, 302/34of the Indian Penal Code.

Son of the informant is said to have gone to his inlaws house from where he informed telephonically that he has been assaulted and administered poison by his wife and in-laws. On the said information, the informant arrived at his matrimonial house where he narrated the said fact to him and later on died en route to the hospital.

It is submitted by learned counsel for the petitioner that the petitioner happens to be father-in-law of the deceased.

During course of investigation, it came into light that there was spate between the deceased and his parents and deceased had consumed poison on way to his in-laws house and died at his inlaws house. At the time of death, the deceased was accompanied by his father-in-law and other family members of the petitioner. All attempts were made to get him treated but on the way he died. Independent persons of the village have also disclosed that the relationship between the deceased and his wife had been cordial. The postmortem report of the deceased does not indicate any internal or external injury. Wife of the deceased has been enlarged on bail by a co-ordinate Bench of this Court vide order dated 03.01.2018 passed in Cr. Misc. no. 45980 of 2017. The petitioner has been languishing in custody since 28.04.2017.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 3, Nalanda at Biharsharif in connection with Noorsarai P.S. Case no. 99 of 2017.
