The petitioner, who is in custody, seeks bail in

connection with Kadirganj P.S. Case No. 76 of 2016 registered for the offence punishable under Sections 147, 148, 149, 341, 342, 323, 325, 307, 379, 302 of the Indian Penal Code.

Informant Devanti Devi in her fardbeyan has stated

that on 26.08.2016 at about 16.00 PM her husband and

younger son had gone for grazing buffalo. In the meantime 20 accused persons including petitioner variously armed with lalthi, bhala and pistol came there and assaulted the husband of the informant and when informant and his children went to

save him then they were also assaulted, causing injury to them.

The husband of the informant sustained grievous injury and

was taken to the Hospital where he was declared dead.

It has been submitted on behalf of the petitioner that petitioner is innocent and has been falsely implicated in this case. There is no specific allegation against the petitioner and petitioner is father-in-law of the own brother of deceased. There is land dispute between the parties. It has been further submitted that similarly placed accused persons have already been granted bail by this Hon’ble Court as contained in Annexure-2.

Learned Counsel for the informant has vehemently opposed the prayer for grant of regular bail to the petitioner.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1^st Class, Masaurhi, in connection with Kadirganj P.S. Case No. 76 of 2016.
