The petitioner apprehends his arrest in Kasma P.S. Case No.100 of 2017 registered under Section 420 of the Indian Penal Code and Section 7 of the E.C. Act.

The petitioner is driver of the tractor on which the foodgrains was being transported.

The learned counsel for the petitioner submits that the petitioner was transporting the foodgrains on the order of its owner and he has no manner of concern with the foodgrains. The P.D.S. shop dealer, Basanti Devi and the owner of the tractor, Chandradeo Sao have already been granted anticipatory bail.

court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Kasma P.S. Case No.100 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
