Petitioner, already in custody, seeks bail in connection with Banmankhi PS Case No.12 of 2018, registered under Sections 341, 323, 384 and 504/34 of the Indian Penal Code as well as under Sections 66(A), 66(E) and 67 of the I.T. Act.

Allegation in brief is that the petitioner, cousin of the informant, snapped some semi nude photograph of the informant and used to blackmail her for establishing physical relationship.

Learned counsel for the petitioner submits that the petitioner is the cousin of the informant and in fact falsely implicated in this case as FIR was lodged by the petitioner’s

side on 18.01.2018 under Sections 307 and others for being assaulted to the other side and the present case has been lodged after six days of the alleged occurrence subsequent to lodging of the case by the petitioner’s side and that is the reason for false implication and the petitioner has no criminal antecedent.

Having considered the aforesaid facts and circumstances, petitioner Neeraj Kuwar @ Niraj Kunwar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Purnea in connection with Banmankhi PS Case No.12 of 2018.
