Heard learned counsel for the petitioners and learned APP for the State.

The petitioners are apprehending their arrest in a case registered under Sections 147, 148, 149, 323, 337, 353, 504 of the I.P.C. and 45 of the Bihar Prohibition and Excise Act, 2016.

The prosecution case, in short, is that on 20.12.2017 at about 5 P.M. the informant went to Chakiya for raid where mahua wine is to be sold and when he reached there along with other police personnel the accused persons including the petitioners raising noise. Then 60 to 65 persons came and started abusing and brick batting.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no

allegation of tampering of witnesses alleged against the petitioners. The petitioner Nos.2 and 3 are ladies. It is further submitted that the police party had gone to outrage the modesty of ladies in question, on which protest was made by the local residents. Later on the police party instituted a false case against the petitioners. There is no recovery of any liquor in the present case.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge II-cum-Special Judge, Excise, Rohtas at Sasaram in connection with Sheo Sagar P.S. case No.394 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
