IA No.518 of 2017 is allowed for the reasons indicated therein. The A.D.M., General Revenue, however, on behalf of the District Magistrate, Motihari is present in person.

The alarming picture, which is petitioner is trying to paint, with regard to the law and order issue in relation to fencing of the graveyard is not supported by the materials and the reports, which had emanated from the district or the subdivision and obviously whole idea behind filing of the writ application if not the contempt was to enhance quick action as well as jumping the queue in matter of allocation of funds and fencing of the graveyard.

The Court is informed however, that the serial number of the present graveyard at Dhaka will now be number one and they

accept that when funds are released in the month of March, the necessary steps will be taken for fencing.
