At the length of argument, in presence of learned counsel for O.P. No.2, learned counsel for the petitioner seeks permission to withdraw this application with liberty to raise the defence/points in trial Court at appropriate stage.
Permission is accorded.
Accordingly, this application is dismissed with
aforesaid liberty.
