2 21-01-2016 Heard learned counsel for the petitioners and the State. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 413, 414, 429/34 of the Indian Penal Code and Section 11 (6) of Animal Cruelty Act.

It is contended that the names of the petitioners have come on the basis of statement made by the co-accused Nazaral Khan that he is dealing in business of selling the meat of stolen animal with the help of the petitioners. Allegedly, such articles were recovered from the Tractor of the petitioner Shahabudin Khan but it is contended that he is not engaged in the alleged activity. It is urged that the involvement of the Tractor does not

mean that the owner was also involved in such type of business. It is further contended that petitioners are having clean antecedent.

Having regard to the facts and circumstances of the case, let the petitioners, namely, Abulaish Sah @ Chulli Sah, Shahabudin Khan and Mustaque Miyan @ Buddha be released on bail in the event of their arrest/surrender before the court below within a period of six weeks from today in connection with Ramnagar P.S. Case No.157/2015, on furnishing bail bonds of Rs.10,000 (Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bagaha, West Champaran subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
