The petitioner being husband of the informant is languishing in custody since 03.12.2016 in a case registered for the offences punishable under sections 498A/304B and 34 of the Indian Penal Code.

Prosecution case is that the daughter of the informant committed suicide due to torture inflicted by her inlaws including the petitioner within three years of marriage.

It is submitted by learned counsel for the petitioner that the petitioner was granted anticipatory bail by a co-ordinate Bench of this Court (now retired) in Criminal Miscellaneous No.18225/2013 vide order dated 14.11.2013 but the petitioner could not furnish bail bonds and was ultimately arrested.

Considering the fact that the petitioner was granted anticipatory bail, on merits, by a co-ordinate Bench of this Court and now he has remained in custody for more than four months, and the investigation has already concluded, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Siwan in connection with Siwan Town P.S. Case No.272/2012.

However, the learned court below will be at liberty to cancel the bail bonds of the petitioner, if he defaults for two consecutive occasions.
