Case No.118 of 2015 registered under Section 379 of the Indian Penal Code and Section 67 of the I.T. Act and, therefore, all these four applications have been heard together and are being disposed of by this common order. The submission is that the petitioners are not named in the F.I.R. In course of investigation, the police got recorded the confessional statement of the co-accused Sattyam Kumar, who disclosed the name of the petitioners having their hands in withdrawing the cash Rs.9,40,000/- through ATM of Tata Indicase. Further submission is that on the basis of the

confessional statement of the aforesaid co-accused, the petitioners have been made accused in this case. The petitioners are in custody since 09.10.2015 and the chargesheet has already been submitted against the petitioners.

Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Smt. Ritu Kumari, Judicial Magistrate, First Class, Patna, in connection with Budha Colony P.S. Case No.118 of 2015. Out of the two sureties, one must be close relative of the petitioners, who will file an affidavit giving genealogy as to how he/she is related with the petitioners. The bailors will undertake to furnish information to the court about any change in the address of the petitioners. Further, the petitioners shall remain present on each and every date during the course of the trial. If the petitioners fail to remain present on two consecutive dates without any reasonable cause being shown, the court concerned would be at liberty to take steps for cancellation of bail bonds of the petitioners.
