Case No. 104 of 2015, registered under Section 25(1-A), 25(1-B)a/c and 26(i)(ii) of the Arms Act, pending in the Court of A.C.J.M.1^st , Munger.

The accusation is of recovery of one loaded country made pistol from the possession of petitioner and on raid of his house, country made S.L.R. rifle with magazine and a D.B.B.L Gun, a country made sixer, a country made kutta and seven live cartridges also recovered.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent is in custody since 11.07.2015.

Learned counsel for the State vehemently opposed the prayer of the petitioner and submits that a huge quantity of arms and ammunitions has been recovered from the possession of the petitioner.

Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to enlarge the petitioner on bail. Accordingly, prayer of the petitioner, above named, is rejected. However, lower court is directed to expedite the trial of the petitioner.
