02/ 10.03.2015 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.

Petitioner is said to have assaulted the injured by means of lathi whereas other accused assaulted the injured with different weapons such as bhala, bhujali .

Admittedly, co-accused Badri Yadav against whom, there is allegation that he gave bhala blow to the injured has already been granted privilege of bail by a bench this court vide order dated 25.03.2014 passed in Cr. Misc. no. 3703/2014.

No doubt, alleged occurrence took place in the year 2003 and the petitioner could be remanded in this case on 20.01.2015 but from perusal of the impugned of the learned Addl. Sessions Judge II, Jamui it would appear that investigation of this case is still pending against the petitioner.

Considering the above stated facts and circumstances as

well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jamui in Chakai P.S. Case no. 35/2003 subject to the condition that petitioner shall attend the learned trial court in person on each and every date for the period of one year or till conclusion of his trial whichever is earlier and if he fails to do so on two consecutive dates without any reasonable explanation, the learned trial court shall be at liberty to cancel the bail bonds of the petitioner.
