The petitioner is languishing in custody since 8.12.2014 in a case registered for the offences punishable under Sections 341,323,436,379 and 504/34 of the Indian Penal Code.

The accusation against the petitioner is of assaulting on the neck of Foko whereas other accused persons assaulted others from informant side. The accused persons also snatched cash and other articles of the informant.

It is submitted by the learned counsel for the petitioner that the accusation has been levelled in the background of serious land dispute when the case was filed before the Bihar Land Tribunal, Patna. It is further submitted that proceeding under sections 107 and 188 Cr.P.C. are pending between the parties and

there is no injury report on record.

Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/(ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Araria in connection with Kurskanta P.S. Case No. 168 of 2014.

Considering the criminal antecedent of the petitioner, the learned court below shall be at liberty to cancel the bail bonds of the petitioner in case the petitioner defaults without any reasonable cause on two consecutive occasions.
