Petitioner is husband of the complainant and is seeking bail in Complaint Case No. 869C of 2010 lodged under Section 498A Indian Penal Code.

It is stated relying on the statement made in the petition that even though he has been lodged in the jail custody but if released on bail, he will make sincere effort to resolve the matrimonial discord and to take his wife back in the matrimonial home with full dignity and honour.

Considering the above, the petitioner abovenamed is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each

to the satisfaction of S.D.J.M., Khagaria in Complaint Case No. 869C of 2010 subject to the following conditions:

(i) One of the bailers shall be the own/close family members of the petitioner.

¶10

(ii) In case of framing of charge, the petitioner shall appear in person on each and every date fixed in the Court below. In case of default in doing so on two consecutive occasions without any cogent/satisfactory reason, the Trial Court shall have liberty to cancel the bail bond of the petitioner and secure his arrest in accordance with law.
