The prosecution case is that petitioner entered into the house of the informant and established forceful physical relationship. The petitioner was caught on the spot by the family members of the informant when family members of the petitioner got him released.

It is submitted by learned counsel for the petitioner that petitioner is agnate of the informant and due to the land dispute the accusation has been levelled. Moreover the informant has retracted from the initial version and has filed a petition to that effect before leaned Court below.
