2 13-10-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341,323,324,307,379,504 and 506/34 of the Indian Penal Code.

The prosecution case is that the informant was making ridge of his land when the nephew of the informant came and abused and gave life threatening, thereafter the family members of the nephew of the informant came along with Ram Pravesh Singh (petitioner no. 2), co accused Abhay Kumar and Dularo Devi (petitioner no. 1) and Prince Kumar and started assaulting informant. When the wife and son of the informant came to rescue they were also assaulted. It is alleged that petitioner no. 1 snatched

the ear rings of the informant’s wife.

It is submitted by the learned counsel for the petitioners that the accusation is omnibus and general and for the occurrence of 20.6.2015 at 7 A.M. the FIR was registered on 21.6.2015 at 4.15 P.M. Though with regard to some of the injuries opinion has been kept reserved but others injuries are simple in nature. The petitioners are agnates of the informant and in the background of land dispute the accusation has been levelled. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Dehri in connection with Dehri (Indrapuri) P.S. Case No. 276 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
