2 03-09-2015 Heard learned counsel for the petitioners and the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 363, 365, 366 of the Indian Penal Code.

Accusation is kidnapping the wife of the informant.

It is submitted by the learned counsel for the petitioners that the petitioners are relatives of the step-mother of the victim and in 164 Cr.P.C. statement the victim has stated that the brother of the step-mother Md. Rafool and Md. Israil took her after offering tea mixed with sedative and thereafter they sold her.

petitioners that under 164 Cr.P.C. statement victim has not named the petitioners. Statement has been made in para-3 of the petition that petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sri Sanjay Singh, Judicial Magistrate, Ist Class, Araria in connection with Narpatganj P.S. Case No. 291 of 2012, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
