2 20-07-2015 Heard learned counsel for the petitioners and the State.

The petitioners are apprehending their arrest in a complaint case in which processes have been directed to be issued after cognizance being taken for the offences punishable under Sections 341, 324, 307, 379/34 of the Indian Penal Code.

It is alleged that the petitioners have intercepted the complainant while he was coming from his clinic being a Homeopathic Doctor. Petitioner no. 1 inflicted injury with knife to the complainant when accused persons also took away Rs. 8,000/- from his bag.

It is submitted by the learned counsel for the petitioners that injury report of the informant is not on record. Considering the totality of the materials collected during investigation the Investigating Officer submitted final report finding the accusation false and the same was accepted but subsequently learned court below proceeded on protest-cumcomplaint and disposed to ensure process after cognizance being taken. It is further submitted that the injury report was not corroborated even with the complaint petition.

Considering the aforesaid facts, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Munger in connection with Complaint Case No. 659 of 2013, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
