The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

It is alleged that co accused Balgovind Choudhary, Sujit Choudhary and the petitioner came and started abusing the informant’s husband when co accused Balgovind repeatedly assaulted the husband of the informant with Pajauna, as a result the husband of the informant fell down, thereafter the husband of the informant was assaulted with lathi by co accused Sujit Choudhary. It is further alleged that the petitioner was addressing the accused to kill the husband of the informant. Subsequently, the husband of the informant succumbed to the injury.

It is submitted by the learned counsel for the petitioner that the accusation of assault has not been levelled against the petitioner. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
