2 19-05-2015 Petitioners are languishing in custody since 25.07.2014 in a case registered for the offences punishable under Sections 25(1-B)a, 26, 35 of the Arms Act. On the information that petitioners are preparing to commit theft of the animals the raid was led when from the possession of petitioner Narad Yadav one country made pistol and one live cartridge were recovered. Though there is no recovery from petitioner Santosh Sharma.

It is submitted by learned counsel for the petitioners that investigation has already concluded and coaccused Sri Kant Sharma @ Sri Lal Sharma has been granted bail vide Cr. Misc. No. 2777 of 2015.

Considering the aforesaid facts, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1^st Class, Saharsa in connection with Sour Bazar P.S. Case No. 349 of 2014.

Since the petitioner Narad Yadav is accused in five other cases, let learned Court below cancel the bail bonds of the petitioner Narad Yadav, if he gets substantially involved in serious nature of offence or defaults for two consecutive occasions during trial.
