The application seeks restoration of MJC No. 3777 of 2012 which stood dismissed as against the contesting opposite party no.2 for non compliance of the order dated 21.01.2013.
Learned counsel for the petitioner with reference to the statements made in paragraph 5, submits that requisites for service of notice were already filed on 20.06.2013 inasmuch as the opposite party no.2 has already appeared in the said proceeding through an Advocate on 28.01.2013.
