The petitioner prays for quashing Memo no.3548
dated 07.11.2013, issued by respondent no.6, whereby his appointment on contractual basis has been cancelled. The petitioner was selected on the post of Panchayat
Technical Assistant under District Rural Development Agency (in
short D.R.D.A.) under the control and command of Rural
Development Department on the basis of open competition.

May, 2007, issued under the signature of Deputy Secretary, Rural Development Department. During the course of his service, the petitioner was transferred to different places including Hilsa Block in the district of Nalanda.

The petitioner submits that a show-cause was asked for some alleged act of omission and commission said to be committed by him. The petitioner submitted his reply. The petitioner submits that the Director, Accounts, Administration and Self Employment also gave his notings to the Deputy Secretary, Bihar Human Rights Commission, Patna that there was no embezzlement in carrying out the scheme. Furthermore, on complaint of the petitioner, in fact, F.I.R. was instituted against one Sateyndra Singh for demand of ransom.

The petitioner submits that without considering the points raised by him in his reply, his contractual appointment has been terminated. The petitioner has moved the learned Commissioner, Patna against the order of his termination. A copy of the representation / Appeal is contained in Annexure-11.

In the facts and circumstances, if the petitioner files a fresh representation along with a copy of this order, the learned Commissioner would dispose of the same within eight weeks from the date of receipt of the same.
