Though the petitioners are the aspirants for their being considered on the post of Physical Trained Teacher sought to be filled up in the lot of 34540 posts vide Advertisement No. 210 of 2010, on a plea that the names of the petitioners had figured in the integrated session-wise seniority list at serial nos. 18040 and 21136 respectively, the learned counsel for the respondents have explained that the petitioners, having completed only one year’s teachers training course in Physical Education and were also from outside the State of Bihar, were not eligible for appointment on the post of Physical Trained Teacher.

In the considered opinion of this Court, the petitioners, in view of Rule-3 of the Bihar State Elementary Teachers Appointment Rule, 2010, were not eligible for appointment on the post of Physical Trained Teacher and, as such, there would be no question of issuing any direction for consideration of their case against the remaining vacancy of Physical Trained Teacher, which has to be filled up strictly in accordance with the direction of the Apex Court including the last order dated 18.7.2013.

That being so, this writ application is wholly misconceived and is, accordingly, dismissed.
