2 04-03-2014 Heard. This is what the petitioner has prayed in para 1 of the writ petition:-
“1. That the present writ application is being filed for the nature of mandamus on behalf of the above named petitioner for giving direction to the learned Court of Collector Patna to dispose off the appeal bearing No. 84 of 2013 which is pending since 31.1.2013 with limitation petition against the order passed by the learned S.D.O. Barh on 27.10.2012 vide Memo no. 1041 dated 27.12.2012 which to learned S.D.O. has pleased to cancel the licence of the petitioner licence No. 302/2007 (P.D.S.) which was granted under a scheme of P. D.S. (Public Distribution Scheme).”
It appears the licence issued to the petitioner under
the Public Distribution System (Control) Order, 2001 ( for short

„Control Order‟) vide License no. 352 of 2007 was cancelled by the licensing authority vide an order dated 27.12.2012 (Annexure1). Aggrieved thereby the petitioner filed an appeal on 31.01.2013.
The grievance of the petitioner is that the said appeal has not till date been considered and disposed of by the appellate authority.
Having heard the parties, this Court is satisfied that the following order shall, in the facts and circumstances of the case, would sub serve the ends of justice:-
Let the appellate authority (respondent no.2) dispose of the appeal preferred by the petitioner being Appeal no. 84 of 2013 filed by the petitioner against the order dated 27.12.2012 (Annexure-1) passed by the licensing authority, if not already disposed of, as quickly as possible preferably within three months from the date of receipt/production of a copy of this order.
