Earlier petitioner approached this court for getting his retirement benefits by filing CWJC no. 9950/2005 and the aforesaid CWJC no. 9950/2005 was dismissed as not pressed but liberty was given to the petitioner to make representation for the left over grievances, if any and concerned respondents were directed to consider and dispose of representation in accordance with law. Learned counsel appearing for the petitioner submits that after order dated 26.07.2006 passed in CWJC no. 9950/2005 petitioner filed representation before the District Education officer, Aurangabad (respondent no. 4) but no order has been passed by the District Education officer, Aurangabad on the above stated representation dated 14.05.2007. It would appear from perusal of record that respondents were given several opportunities to file counter affidavit but all went in vain. However, learned counsel for the petitioner submits that this petition may be disposed of with direction to the District Education officer,
