Admittedly, the petitioner retired in the year 2000 and gratuity amount was paid on 13.06.2008 without reckoning the interest due to delayed payment.

Learned counsel for the petitioner submits that according to Section 7 (3-A) of Payment of Gratuity Act, 1972, the employer is duty bound to make payment of statutory interest

on account of delayed payment of gratuity amount.

In view of the aforesaid submissions as well as facts and circumstances of the case, this petition stands disposed of with direction to respondent no. 3/concerned respondents to consider the above stated grievance of the petitioner in the light of Section 7 (3-A) of Payment of Gratuity Act, 1972 within two months from the date of receipt/ production of a copy of this order and if the grievance of the petitioner is found proper and genuine, the respondent no. 3/concerned respondents must ensure the payment of interest due to delayed payment of gratuity amount to the petitioner within the above stated period of two months.
