The petitioners apprehend their arrest in connection with Raushanganj PS Case No. 01 of 2013 instituted for the offence punishable under sections 364/34 of the Penal Code. Accusation is that the accused persons including the petitioners have caused the disappearance of the informant’s daughter for non-fulfillment of dowry demand.

It is submitted that the informant’s daughter had in fact gone missing from the petitioners’ house having left voluntarily with her paramour for which a Sanha had been lodged

on 11.10.2012 itself. It is further submitted that similarly situated co-accused and family members of the petitioners have been granted anticipatory bail by this court vide Cr. Misc. No. 7347/2014 on 21.4.2014 and Cr. Misc. No. 39123/2013 on 5.3.2014.

Having regard to the entirety of the facts and circumstances of the case, let the petitioners above named be released on anticipatory bail in the event of their arrest or surrender in connection with Raushanganj PS Case No. 01/2013 on furnishing bail bonds of rupees ten thousand each with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Sherghati at Gaya subject to the conditions laid down under section 438 (2) of the Code of Criminal procedure and further that the petitioners shall remain physically present in court during the trial on each and every date and failure to do so on two consecutive dates shall result in cancellation of their bail bonds.
