The petitioner apprehends his arrest for the offences alleged under Sections 420, 120B, 406, 323, 504/34 of the Indian Penal Code registered in connection with Complaint Case No. 137 of 2009.

Accusation is that the accused persons sold a tractor to the complainant for which payment of Rs. 1,45,000/- was made but the owner book, trailor etc. were not delivered to the complainant.

Pursuant to the order dated 3.2.2014 the matter was directed to be placed before the Patna High Court Mediation and Conciliation Centre. The mediator’s report

dated 23.4.2014 in Mediation Proceeding No. 165 of 2014 has been received disclosing that the disputes between the parties have been successfully resolved.

Having regard to the entirety of the facts and circumstances of the case, as such, in the event of the petitioner’s arrest or surrender before the court below within six weeks from the date of communication of this order, let the above named petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Sri Manoj Kumar, J.M., Ist Class, Madhepura, in connection with Complaint Case No. 137 of 2009, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
