The petitioner seeks bail in a case which has been registered against him and others under Section 366/34 of the Indian Penal Code. The informant’s daughter Kunti Devi was married one year prior to the occurrence with Ajay Yadav. Allegation is that on 6.9.2013 Kunti Devi was taken away by the petitioner and others.

Submission is that Annexure-2 is the statement under Section 164 of the Cr.P.C. of the victim in which she has stated that her husband was a drunkard he was frequently assaulting her and so she married with the petitioner in the court and thereafter

escaped to Delhi.

Considering the statement of the victim under Section 164 of the Cr.P.C., the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate/court concerned, Araria in connection with Narpatganj P.S. Case No. 259 of 2013.
