2 19-04-2014 Heard learned counsel for the petitioner, the State and the counsel for the informant.

Petitioner is apprehending his arrest in connection with a case registered for the offence under Section 354 of the Penal Code. He claims himself to be 65 years of age and is said to have committed sexual overt act on a girl of five years. The alleged overt act is said to have been committed in front of a flour mill of Chandan Choudhary and the incident was seen by many witnesses, who have also disposed against the petitioner. In the circumstances, I am not inclined to consider his request for grant of bail in the event of arrest.

Let petitioner surrender in the court of Chief Judicial Magistrate, Buxar in connection with Nawanagar P.S. Case No. 23/14 within a period of four weeks from the date of receipt/ production of a copy of this order in the Court below and apply for regular bail, which should be considered in accordance with law.

This petition is, accordingly, disposed of.
