Petitioners are apprehending their arrest in connection with a case registered for the offence under Sections 420, 467, 468, 471 of the Penal Code. They are the vendees of the sale deed by which the informant has conveyed 7 kathas of land in plot nos. 1411, 1640, 1860, 1861 appertaining to khata nos. 62, 04 of village Telhua North, P.S. Nautan though consideration money for sale of 10 dhurs of land in the said plot was received but committing fraud two petitioners have obtained sale deed for 7 kathas.

It is submitted on behalf of the petitioners that after one year of the execution of the sale deed the present First Information Report has been lodged. It is further submitted that petitioners having paid Rs. 2,36,000/- could not have settled for execution of only 10 dhurs of land. Aforesaid contention of the petitioners is subject to the result of the present case but until

disposal of the said case if petitioners file an affidavit in the Court below that they will not claim possession beyond 10 dhurs of land in the aforesaid plots until present prosecution fail, petitioners, above named be released on bail on furnishing bail bonds of Rs. 5,000/-(Rs. Five Thousand Only) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bettiah, West Champaran in connection with Bettiah Town P.S. Case No. 615/13, subject to the conditions laid down under Section 438(2) Cr.P.C., provided they surrender in the court below within a period of four weeks from the date of receipt/production of copy of this order in the court below and file the said affidavit, otherwise dealt with in accordance with law without being prejudiced by the fact that this Court has not admitted the petitioners to the privilege of bail in the event of arrest.
