The petitioner seeks bail in connection with Sessions Trial No.961 of 2013 arising out of Shahkund P.S. Case No.179 of 2012 registered for the offences punishable under Sections 324, 448 and 307 read with Section 34 of the Indian Penal Code as well as 27 of the Arms Act.

The prayer for bail of the petitioner was rejected earlier by this Court vide order dated 13^th January, 2014 passed in Cr. Misc.29006 of 2013.

It has been contended that though there is allegation of firing against the petitioner, but the nature of injury sustained by the informant has not been disclosed by the doctor, who examined him. It has further been pointed out that from perusal of the injury report it would be evident that the injury sustained by the informant was superficial in nature.

Be that as it may, taking into consideration the fact that the petitioner is in custody since 18^th February, 2014, he is directed to be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount to the satisfaction of learned 1^st Assistant Sessions Judge, Bhagalpur in connection with Sessions Trial No.961 of 2013/ Tr. No.104 of 2013 arising out of Shahkund P. S. Case No.179 of 2012, subject to the condition that one of the bailors must be a family member.
