The petitioner is accused in connection with Bathnaha P.S. Case No. 89 of 2013 registered under Section 394 of the Indian Penal Code.

Regarding road robbery the case was instituted by the informant, Sujay Mahto, against unknown.

Learned counsel for the petitioner submits that in course of investigation, the robbed motorcycle was recovered behind the hut of Jatan Das from where the petitioner and four persons were apprehended while the petitioner was put on T.I.P. but he was not identified by the informant. Learned counsel for the petitioner further submits that similarly situated co-accused, Rakesh Kumar Rai @ Rakesh Rai, who was also apprehended with this petitioner, has already been granted privilege of bail by

this Court vide order dated 17.12.2013 passed in Criminal Misc. No. 49772 of 2013. It is further submitted that petitioner in custody since 22.10..2013.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi in connection with Bathnaha
