The petitioner seeks bail in a case which has been registered under Section 307 and some other Sections of the Indian Penal Code, Section 27 of the Arms Act, Sections 3/5 of the Explosive Substances Act and Section 17 of the C.L.A. Act. Submission is that no case either under Sections 307 or 436 has been made out against the petitioner. The implication is on account of enmity. The petitioner is in custody since 6.6.2002 in another criminal case and has been remanded in this case on 29.7.2011 without any evidence. Similarly situated accused Raghunath Yadav has been granted bail in Cr. Misc. No. 4209 of 2007 on 13.2.2007.

Considering the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Ad hoc Additional Sessions Judge/court concerned, Kaimur at Bhabua in connection with Sessions Trial No. 431 of 2011/106 of 2013, arising out of Adhaura P.S. Case No. 11 of 1997.
