The petitioner seeks bail in a case which has been registered against unknown under Sections 302, 379, 201/34 of the Indian Penal Code. The informant’s cousin Mukesh Rai was killed for the purpose of looting tractor.
Submission is that the petitioner is not named in the FIR and his name has come on the basis of confessional statement of co-accused which has got no evidentiary value. On the basis of confessional statement of Hira Ram and Tinku Sharma the name of the petitioner and others including Dhananjay Mahto and Md. Firoj have come who have been granted bail. There is no witness of the occurrence.

Considering the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate/court concerned, Saran in connection with Morhowrah P.S. Case No. 112 of 2013.
