The petitioner seeks bail in a case which has been registered for offence under Section 302 of the Indian Penal Code and 27 of the Arms Act.
Though the petitioner has been named as sole assailant of the deceased but it has been submitted that during investigation the witnesses have named the petitioner and one Badri Singh as the assailants. When the informant heard sound of firing, the petitioner was just crossing from there. The allegation of firing is against the petitioner but during investigation, the witnesses have stated that Badri Singh was the person who committed the murder. In paragraph 3 of this application, it is mentioned that the petitioner has no criminal antecedent.

Considering the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/-(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate/concerned court, Samastipur in Samastipur (Muffasil) P.S.Case No. 516 of 2013.
