4 11-07-2014 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in G.R. No. 501 of 2011 arising out of Tarabari P.S. Case No. 117 of 2011 dated 13.03.2011 instituted under Sections 414/384/387/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has been made accused only on suspicion that he was also involved in the racket of extortion. Learned counsel submits that nobody has taken his name for demand of extortion and also no overt role has been assigned to him by any person. Learned counsel has further submitted that the brother of the petitioner

against whom there is similar allegation has been granted bail by the court below itself though the case of the petitioner stands on a better footing. It is submitted that the petitioner is in custody in the present case since 15.09.2011.

Learned A.P.P., upon going through the case diary, submits that the petitioner has at least 10 cases against him under grave sections of the Indian Penal Code. Learned counsel further submits that in the application itself the petitioner has given at least 19 other cases against him at paragraph 3. He further submits that witnesses who have been examined during investigation have supported the prosecution story.

Considering the facts and circumstances of the case and submissions of learned counsels for the parties, this Court is not inclined to enlarge the petitioner on bail.

Accordingly, the application stands dismissed.

Learned counsel for the petitioner submits that the court below had directed the trial to be concluded within six months in September, 2013 itself but the same has not been done.

¶19

In view of the aforesaid, the trial court shall ensure expeditious disposal of the case.
