The petitioner seeks bail in a case which has been registered against four unknown for offence under Section 392 of the Indian Penal Code regarding robbery of Rs.2 lacs and in course of investigation, on the confessional statement of coaccused Nitish Kumar, Rs.67,000/- was recovered from the house of the petitioner.
Submission is that the petitioner is not named in the
first information report and he has not been put on test identification parade. The recovered amount is not the robbed money and the person who has confessed about inculpability of the petitioner has been granted bail by the court below itself. Considering the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/-(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate/concerned court, Begusarai in Muffasil P.S.Case No. 407 of 2013.
