JUSTICE DINESH KUMAR SINGH ORAL ORDER 2 09-01-2014 The present application has been filed for quashing of the order dated 21.10.2013 passed by learned CJM, Buxar in Dumraon P.S. Case No. 167 of 2013 whereby the process has been directed to be issued after cognizance being taken for the offences punishable under Sections 420, 419 and 120B of the IPC.
The prosecution case is that the petitioner was recruited on the post of constable in Bihar Police but during medical examination, the height of the petitioner was found 3.5 CM less than the height claimed by the petitioner.
It is submitted by learned counsel for the petitioner that even assuming the accusation, at best, the case is made out only under Section 419 IPC and not under Section 420 IPC.
This Court is not inclined to interfere in the matter at this stage.
Accordingly, the application is disposed off with liberty to the petitioner to raise all the contentions at the time
