The petitioners herein are close relatives of the informant. In order to insist partition in the family it is alleged that they on the relevant date and time entered into the house and thrashed /assaulted the informant.

Learned counsel for the petitioners submits that the injuries are simple in nature. Both the parties belonged to the same family. The situation had arisen owing to dispute relating to partition in the property of the family. There is no criminal antecedent against the petitioners except one case of theft under Section 379 of the IPC earlier lodged by the present informant.

Considering the facts and circumstances of the case, let the petitioners, named above, in the event of their arrest or surrender before the learned Court below within a period of three

weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 15,000/- ( Fifteen thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Hilsa, Nalanda in connection with Nagarnausa P.S. Case No. 126 of 2013 subject to the conditions as laid down under Section 438(2) of the Cr.P.C with following conditions:-

(I) One of the bailors shall be the own/close family member of the petitioners. (II) The petitioners shall appear in person before the Court below on the date fixed at the trial. In case of default in such appearance on two consecutive dates, the Trial Court shall have liberty to cancel the bail bond of the petitioners. (III) The present arrangement shall continue up to the stage of framing of charge, if any, in the trial to be taken up pursuant to the conclusion of the investigation of the case.
