The two petitioners herein are full brothers. They seek privilege of anticipatory bail in a case instituted under diverse sections of the Penal Code including 308 IPC.

A dispute arose between the informant and her men on one side and the accused persons on the other side over sitting on a platform (chaputra) near the house of the informant. The matter aggravated and the co accused Budhan Manjhi is said to have gave Garansha blow on the head of the informant as a result of which she sustained injuries.

The contention of the petitioners is that specific allegation of assault is attributed to the co accused Budhan Manjhi and all the penal provisions except section 308 IPC are bailable.

Having heard the parties and on perusal of materials on record including the facts appearing from the impugned order, in my view, the petitioners deserve privilege of anticipatory bail particularly when they do not carry any criminal antecedents as stated in paragraph 3 of the bail petition.

Accordingly, in the event of arrest/surrender within three weeks from today, petitioners above named shall be released on bail on furnishing bail bonds of Rs. 10,000/- each, with two sureties of the like amount each to the satisfaction of Addl. Chief Judicial Magistrate, Hilsa(Nalanda) in connection with Nagarnausa P.S. No.98/2013 on condition that one of the bailors of the petitioners shall be their own/close family members.
