Petitioner apprehending his arrest in connection with Kishanganj P.S. Case No. 307 of 2012 initially instituted under Section 419/34 of the Indian Penal Code (later 420 IPC added) has filed the present application seeking anticipatory bail. In sum and substance, the allegation is that the Motor Vehicle Inspector alongwith 3-4 persons were found engaged in checking vehicles. The purpose obviously was extracting money. On query, the petitioner is said to have stated that he too is an employee in the Government. Subsequently, it was found that the petitioner is not an employee of the Government. It has also come that the petitioner is not relative of the Motor Vehicle Inspector. occurrence were granted privilege of anticipatory bail.

Submission of the petitioner is that on the said allegation at best it can be a case under Section 419 of the Indian Penal Code. The persons who are similarly placed have been granted anticipatory bail by the learned Court below.

Considering the facts and circumstances of the case, in the event of arrest or surrender in the Court below within three weeks, the petitioner abovenamed shall be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj in connection with Kishanganj P.S. Case No. 307 of 2012 subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure with further condition that one of the bailors shall be own/close relative of the petitioner.
