4 09-05-2014 Heard learned counsel for the petitioners and learned counsel for the State. Cr. Misc. No. 5325 of 2014 filed on behalf of Dipak Ram and Cr. Misc. No.4962 of 2014 filed on behalf of Sujeet Kumar Rai have been taken up together because both the cases have arisen out of one occurrence. The case was registered under

The officer-in-charge is the informant he received information that some persons were selling stolen motorcycle. A raid was conducted and the petitioner Dipak Ram has been apprehended.

Submission is that the petitioners have been falsely implicated at the behest of the officer-in-charge. Nothing has been recovered from their possession and the SIM which has been recovered is not a stolen property.

Considering the facts and circumstances of the case, let the above named petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate/court concerned, Samastipur in connection with Patori P.S. Case No. 360 of 2013.
