Initially a complaint case was lodged filed which was sent to police and the FIR registered under Sections 406, 420, 387, 384, 385 and 506 of the Indian Penal Code, Section 27 of the Arms Act and Section 38 of the N.I. Act. It has been alleged that the cheque was dishonoured.

Learned Counsel appearing on behalf of the petitioner has submitted that parties were known to each other from before and there was dispute with regard to some contract work. The cheques were issued in usual course of business transaction. The cheque which was signed was not present before the bank and the cheque which was not signed were deliberately

present before the bank.

Considering the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate/court concerned, Raxaul, East Champaran at Motihari in connection with Chauradano P.S. Case No. 9 of 2013.
