JUSTICE SHYAM KISHORE SHARMA ORAL ORDER 3 10-04-2014 Heard learned Sr. Counsel for the petitioner and learned APP for the State. The petitioner is the husband of the deceased of the case registered under Sections 304B/34 of the Indian Penal Code. Informant’s younger sister Sangeeta Devi survived hardly one year after her marriage with the petitioner. Prior to her death, she used to complain about ill-treatment by the accused persons. Three months prior to the occurrence the petitioner took her and promised that he would not misbehave with her in future but again his torture continued. Ultimately she was killed and no one was found in the house.
Submission is that there is general and omnibus allegation against all the accused persons.

The petitioner is the husband of the ceased. The case of the husband cannot be equated with others. The death is within seven years of marriage and allegation is that prior to her death the victim was pressurized to bring additional dowry.
Considering the allegation, prayer for bail of the petitioner is rejected in connection with Masaurhi P.S. Case No. 135 of 2012.
