The petitioners seek bail in a case registered against 26 named accused persons under Section 302 and some allied sections of the Indian Penal Code.

Maternal granddaughter of Alakh Dev Ram had gone to attend her natural call but Shailesh Singh was flashing torch in that very position which was strongly contended by the villagers where a big mob assembled and indiscriminately

Submission is that the allegation of assault is not specific against the petitioner. It was the conduct of Shailesh Singh which invited the rage of villagers. Shailesh Singh was a man of questionable character. There is counter case also which gives another version of the occurrence.

Considering the facts and circumstances of the case, the petitioners above named are directed to be released on furnishing of bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M./concerned Court, Saran at Chapra in connection with Garkha P.S. Case No. 179 of 2013.
