This is second attempt on behalf of the petitioner, whose prayer was earlier refused vide order 13^th September 2012 passed in Cr. Misc. No. 20036 of 2012, in connection with Chhabilapur (Rajgir Mufasil) P.S. Case No. 37 of 2009, pending before the Chief Judicial Magistrate, Nalanda as is evident from the report of the trial Court, received through letter no. 178 dated 11^th March 2014, out of thirteen chargesheet witnesses, eleven witnesses including doctor and informant have already been examined and the matter is pending only for examination of I.O. and another public witness for which steps have already been taken.

Having regard to the facts and circumstances, there appears no reason to change the stand already taken.

Accordingly, the prayer for regular bail of the above named petitioner, in connection with S. Tr. No. 464 of 2012

arising out of Chhabilapur (Rajgir Mufasil) P.S. Case No. 37 of 2009, pending before the learned Ad-hoc Additional District Judge-I, Nalanda, Biharsharif, is hereby refused.

Simultaneously, the trial Court is directed to do all the needful to prove its expectations and disposal of the case preferably within a period of four months.

Let this order be communicated to the court aforementioned through FAX at the cost of the petitioner.
