2 25-03-2014 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners, who are apprehending their arrest in connection with a case registered for the offence punishable under Sections 304(B),201 and 511 of the Indian Penal Code as well as ¾ of the D.P. Act, are named accused being in-laws of deceased sister of the informant who died within a year of her marriage under unnatural circumstance after suffering for certain demands, torture etc.

Submission is of false implication under some confusion and on being aware of the truth the informant has already entered into compromise and due petition to this effect is on record to the Court below.

the court below, on due identification, supports the factum of compromise and contents made therein with his/her free will and consent without any coercion and also stood as one of the bailors, in the event of their arrest or surrender before the court below within four weeks, let the petitioners abovenamed be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand only) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra, in connection with Sonpur P.S. Case No. 190 of 2010, subject to condition laid down under Section 438 (2) of the Code of Criminal Procedure with additional condition to remain physically present before the court below on each and every date at least for two years or till disposal of the case, whichever is earlier and in case of failure on two consecutive dates without giving any reasonable explanation, the liberty granted shall be deemed to be cancelled.
